Negotiations on cluster munitions within the Convention on Conventional Weapons (CCW) framework are slated to start in a full-force, final attempt to secure agreement on a protocol text during the upcoming CCW 4th Review Conference in Geneva from 14–25 November.

Wien/Genf/Hd. Sie sind klein, meist bunt, fast wie eine Art Kinderspielzeug – und sie können tödlich sein: die vielen kleinen Sprengkörper, die von Streubomben freigesetzt werden. Noch Jahre nach dem Ende eines Krieges sind sie eine heimtückische Gefahr. Nach zähen Verhandlungen wurde daher 2008 die „Oslo-Konvention“ geschlossen, die bisher 109 Staaten unterzeichnet und 59 davon ratifiziert haben. Sie enthält ein Totalverbot – doch dieser Standard könnte durch ein neues Abkommen unterhöhlt werden, über das diese Woche im Rahmen der „Konvention über konventionelle Waffen“ in Genf verhandelt wurde. Denn der Entwurf sieht nur eine Vernichtung älterer Bestände vor. „Das bringt nicht nur keinen humanitären Mehrwert, es ist vor allem ein gewaltiger Rückschlag im Kampf gegen diese grausame Waffe“, sagt Judith Majlath von der NGO „Cluster Munition Coalition“ Österreich.

Wien/Genf 22.08.2011„Die derzeitigen Verhandlungen im Rahmen der KWK (Konvention über bestimmte konventionelle Waffen)CCW zu einem Protokoll über Streumunition drohen, die hohen Standards der Oslo-Konvention(CCM) zu untergraben.“ so Judith Majlath, Direktorin von CMC Austria. „Durch die Oslo-Konvention konnte 2008 ein Totalverbot von Streumunition erreicht werden. Durch den gerade in Genf laufenden Verhandlungsprozess besteht die Gefahr, zu einem erreichten hohen Standard im humanitären Völkerrecht einen niedrigeren Alternativstandard zu kreieren. „Dies ist ein einzigartiger und gefährlicher Präzedenzfall.“, so Frau Majlath.

Wien, 16. Mai 2011 - Die EU hat das Jahr 2011 zum „Europäischen Jahr der Freiwilligentätigkeit“ ausgerufen. Rund 94 Millionen Menschen engagieren sich in Europa auf freiwilliger Basis. Österreich zählt mit über 40 Prozent Freiwilligen zu den europäischen Spitzenreitern. „All diese Freiwilligen sind wichtige Zahnräder im Getriebe, das das Gemeinwohl unserer Gesellschaft am Laufen hält“, so der Außenminister im Rahmen der feierlichen Ehrung im Marmorsaal des Außenministeriums.

(London, 7 February 2011) – Thomas Nash stepped down as coordinator of the Cluster Munition Coalition (CMC) on 31 January 2011 after seven years of inspiring leadership of the global campaign to ban cluster bombs. Under his direction, the CMC grew immensely from its founding in 2003 through the negotiation, adoption and entry into force of the Convention on Cluster Munitions.

Austria is a unique case regarding implementation. One might say that Austria implemented the Convention before it even existed. Let me explain: CMC-Austria began the campaign for a ban on cluster munitions in 2003 with extensive lobbying efforts, which then led up to the parliamentary briefing in 2006 essential in raising awareness of the humanitarian consequences of CM and to understand commonalities and differences in positions of the various stakeholders. CMC-Austria publication launch at 1 MSP in Laos

During the First Meeting of States Parties to the Convention on Cluster Munitions (1 MSP) in Laos CMC-Austria launched its publication "Banning Cluster Munitions: The Austrian Process: An NGO Perspective" at a reception in honour of civil society hosted by the Austrian Government on 11 November.
This report on the history of the parliamentary and legislative process in Austria towards a ban on cluster munitions presents lessons learnt from Austria useful for other governments and CMC campaigners when aiming for national legislation on cluster munitions.
Moreover, it presents a legal analysis of the various stages towards the Austrian Federal Act on the Prohibition of Cluster Munitions and may serve as an example of how to resolve controversial substantive issues as well as of how to ensure a sucessful cooperation between governments, civil society, MPs and journalists united in their common cause to ban cluster munitions.
CMC-Austria was the driving force behind banning cluster munitions in Austria. This report also gives credit to CMC-Austria's achievements in this context. At the reception Ambassador Marschik, director of the department of disarmament of the MFA in Austria thanked Judith Majlath, Director of CMC-Austria, for her efforts and emphasised the essential role of CMC-Austria as well as of all members of CMC in this process and in pushing towards a cluster bomb free world.

(Vientiane (APA) - Die Cluster Munition Coalition Austria (CMC-Austria) hat am Rande des ersten Treffens der Mitgliedsstaaten der Konvention zum Verbot von Streumunition (CCM) in Laos auch Bilanz der eigenen Lobbying-Arbeit für das Verbot dieser Waffen gezogen. Die Direktorin von CMC-Austria, Judith Majlath, betonte bei der Präsentation einer diesbezüglichen Publikation, dass man auch mit limitierten finanziellen und personellen Mitteln erfolgreich sein könne. Dies sollte für andere NGO's eine Ermutigung sein.

Wien (APA) - "Das Inkrafttreten der Konvention zum Verbot von Streumunition ist ein wichtiger Meilenstein in der internationalen Abrüstung und ein bedeutender Tag für die Streumunitionsopfer weltweit", betonte Außenminister Michael Spindelegger zum Inkrafttreten der internationalen Konvention zum Verbot von Streumunition kommenden Sonntag. Die ab August gültige Konvention verbietet Einsatz, Herstellung, Lagerung sowie Import und Export dieses Waffentyps, und enthält bahnbrechende Bestimmungen zur Opferhilfe. Bis heute haben 106 Staaten die Konvention unterzeichnet, 37 ratifiziert.

Er sei "erfreut", dass die internationale Konvention zum Verbot der "abscheulichen Waffen" ab Sonntag gelte, erklärte Ban am Freitag in New York.

Wien (APA) - Die internationale Konvention zum Verbot von Streumunition tritt am 1. August 2010 in Kraft. Nach der Ratifikation durch die Unterzeichnerstaaten Burkina Faso und Republik Moldau (Moldawien) im Februar haben mehr als 30 Unterzeichnerstaaten die Konvention ratifiziert, die damit als bindende vertragliche Verpflichtung für die Unterzeichner in Kraft tritt. Die bereits von mehr als 100 Staaten unterzeichnete Konvention verbietet die Herstellung und den Einsatz von Streubomben, die riesige Mengen kleiner Sprengsätze über eine große Fläche verteilen.

Der 1.August ist ein gutes Datum für die Bewegung zum Verbot von Streubomben. Der von uns allen unterstützte Oslo-Prozess findet an diesem Tag mit Inkrafttreten der Konvention einen weiteren Höhepunkt. 106 Staaten haben die Konvention bisher unterzeichnet und 30 bereits ratifiziert. Ich bin stolz darauf, dass Österreich zu den Vorreitern der Konvention zählt und diese als 6. Staat ratifiziert hat.

(Vienna, London, 8 July 2010) – The European Parliament passed a resolution on 8 July calling on European Union member states to sign and ratify the Convention on Cluster Munitions “as a matter of urgency,” the Cluster Munition Coalition (CMC) said today. The Convention enters into force and becomes binding international law on 1 August.

Straßburg (APA) - Das Europaparlament hat 16 säumige EU-Staaten aufgerufen, die mit August in Kraft tretende Anti-Streumunition-Konvention (CCM) umzusetzen. Die Unterzeichnung beziehungsweise Ratifizierung der Konvention durch alle EU-Staaten sei eine "dringliche Angelegenheit", heißt es in einer am Donnerstag in Straßburg mit 558 zu 30 Stimmen beschlossenen Resolution.

An accident had killed a minority 38-year-old man, a breadwinner of eight-member family, on the spot at 10:30 a.m. on Friday, February 12, 2010. The explosion occurred in Mai Lanh Village, Mo O Commune, Dakrong District, the western part of Quang Tri Province, along the former wartime DMZ. The mournful accident happened at the time when most people don’t work and stay home to prepare for the Vietnamese traditional lunar Tet holidays which began on February 14, 2010.

Ten years after the Mine Ban Treaty (MBT) entered into force, 67% of survivors feel that their needs have not been taken into account by national victim assistance plans.

The use of cluster munitions by both Russia and Georgia resulted in the deaths of at least 16 civilians and injured at least 54 more. One year on, unexploded cluster submunitions still continue to render tracts of farmland hazardous and pose a daily threat to local inhabitants.

The use of cluster munitions in the armed conflict between Israel and Hezbollah which ended exactly three years ago resulted in over 340 civilian casualties in Lebanon and around 13 casualties in Israel. Even now, unexploded cluster submunitions still continue to render tracts of farmland hazardous and pose a daily threat to local inhabitants in southern Lebanon.

Die Konvention wird sechs Monate nach der Ratifikation durch den 30. Unterzeichnerstaat in Kraft treten. Bis heute haben 98 Staaten die Konvention unterzeichnet und zehn Länder haben sie ratifiziert.

Banning Cluster Munitions: Government Policy and Practice was released on 29 May 2009. The report documents the creation of an international treaty banning cluster munitions. It looks at governments’ engagement in the Oslo Process, a diplomatic initiative started by Norway in February 2007 to create a legally-binding instrument outlawing cluster munitions and establishing a framework for clearing contaminated areas and meeting the needs of cluster munition victims. The report also considers government practice with respect to the use, production, stockpiling, and transfer of cluster munitions.

(Tipperary, Ireland: 1 May 2009) - The Cluster Munition Coalition (CMC) today accepted the 2008 Tipperary International Peace Award in recognition of its successful five-year campaign to outlaw cluster bombs. “We are grateful to the Tipperary Peace Convention for recognizing the coalition with this award, but our success banning cluster bombs was the result of the strong partnership forged between likeminded governments and civil society and not the CMC’s work alone,” said CMC coordinator Mr. Thomas Nash.

AMENDMENT TO THE ORIGINAL FEDERAL LAW ON THE PROHIBITION OF CLUSTER MUNITIONS

The amendment to the original Federal Law on the Prohibition of Cluster Munitions concerned most importantly § 1 . The definition of prohibited cluster munitions in the old version of the Federal Law did not adequately cover explosive sub-munitions but rather stressed the “container” as being at the core of the prohibition. This is mainly why the amendment sought to replace the existing definition contained in § 1 by incorporating a general reference to Art. 2 (2) of the CCM to define cluster munitions prohibited by this Federal Law in line with the CCM to ensure speedy ratification of the CCM by Austria.

Wien, 2 April 2009 – Als insgesamt erst 6. Land hat Österreich durch Botschafter Alexander Marschik, Leiter der Abrüstungsabteilung im Außenministerium, der die Ratifikationsurkunde hinterlegte, am Freitag die Konvention zu Streumunitionen bei den Vereinten Nationen in New York ratifiziert. Nachdem Österreich bei den Vorbereitungsarbeiten, den Verhandlungen und der Unterzeichnungskonferenz zu diesem bahnbrechenden Menschenrechts- und Abrüstungsvertrag eine Vorreiterrolle eingenommen hatte, untermauert die prompte Ratifizierung dieses Streumunitionsverbotsvertrages einmal mehr, wie ernst Österreich das Ziel ist, die Welt von den humanitären Folgen von Streumunitionseinsätzen zu befreien.

Wien (APA) - Österreich hat als sechstes Land das internationale Übereinkommen zum Verbot von Streumunition ratifiziert. Das Abkommen, das den Gebrauch, die Herstellung, die Lagerung und den Transport von Streumunition ächtet, wurde am Donnerstag, nach der Ratifizierung durch den Nationalrat und den Bundesrat in den vergangenen Wochen von Bundespräsident Heinz Fischer unterzeichnet. Der österreichische Botschafter Alexander Marschik reiste am Freitag nach New York, um den Vertrag bei der UNO zu hinterlegen. Am Samstag (4. April) ist der "Internationale Tag zur Aufklärung über Minengefahren", an dem die UNO an die Anti-Minen-Konvention erinnert.

CMC WELCOMES AUSTRIA RATIFICATION OF CLUSTER BAN TREATY

On April 2, Austria became the 6th country to formally ratify the Convention on Cluster Munitions by depositing its legal instrument at the United Nations in New York. After playing a key role in the development of the treaty and signing it in December in Oslo, the ratification shows the continued commitment of Austria to a world free of cluster-bombs.

Wir haben vernommen, dass unserer Bemerkungen vom 28. Februar 2009 zur Ratifikation des Übereinkommens über Streumunition zu Unklarheiten geführt haben. Hierzu möchten wir folgende Klarstellungen vornehmen:
1.CMC Austria unterstützt nachdrücklich das Oslo Übereinkommen über Streumunition und bittet die Parlamentsabgeordneten, zur möglichst raschen Ratifikation des Übereinkommens beizutragen.
2.CMC Austria unterstützt ebenso die Anpassung des österreichischen Bundesgesetzes an das Oslo Übereinkommen, so wie es in der Regierungsvorlage vorgesehen ist.

März 1999 bestehen die zentralen Herausforderungen heute vor allem in der Minenräumung, der Zerstörung von Lagerbeständen sowie der Unterstützung von Minenopfern, so Judith Majlath, Direktorin der Österreich-Sektion der "Internationalen Kampagne für das Verbot von Landminen" (ICBL) in einer Aussendung zum Jahrestag. Mittlerweile hätten das Abkommen zwar 156 Länder ratifiziert, 39 Staaten würden sich aber noch weigern.

Wien/Oslo (APA) - Als einen "Sieg der Humanität" bezeichnete die Direktorin der österreichischen Sektion der Internationalen Cluster Munition Coalition (CMC), Judith Majlath, das internationale Abkommen zum Verbot von Streubomben, das am Mittwoch von über 100 Staaten in Oslo unterzeichnet wurde. Der Vertrag enthalte klare Verpflichtungen für die Unterstützung von Opfern und zur Zerstörung von Lagerbeständen, sodass diese Waffen nicht mehr zum Einsatz kommen könnten, erklärte die CMC-Direktorin am Donnerstag in einer Aussendung.

Regional Conference Opens in Beirut, Lebanon
(Beirut, Lebanon: 11 November 2008) Governments of the Middle East and North Africa region should sign the new international treaty banning cluster munitions when it opens for signature in Oslo on 3 December 2008, the Cluster Munition Coalition (CMC) said today. The campaign issued its call at the opening of a two-day regional meeting on cluster munitions in Beirut, Lebanon.

In a surprise announcement, Chair Wigotski convened the final plenary with a proposal to “stop the clock.” Wigotski proposed that discussions continue next week in order to produce a new Chair’s text and a new mandate to continue work next year.

(Geneva, Vienna, September 2, 2008) – A network of 250 non-governmental organisations across 70 countries has condemned Georgia’s use of cluster munitions, just three months after 107 nations agreed to ban the weapon. In a letter to Human Rights Watch, the Georgian Defense Ministry stated that cluster bombs were “used against Russian military equipment and armament marching from Roki tunnel to Dzara road [sic],” but that they “were never used against civilians, civilian targets and civilian populated or nearby areas.” The majority of the world's nations that have banned the weapon have declared any use of any cluster munition in any location unacceptable, because of the harm they cause to civilians during and after conflict.

(WIEN, 1.9.2008) Ein Vertreter des georgischen Verteidigungsministeriums hat gegenüber der Menschenrechtsorganisation Human Rights Watch (HRW)zugegeben, im jüngsten Kaukasus-Konflikt nahe des Roki-Tunnels, der Südossetien mit Russland verbindet, Streumunition des Typs M85 eingesetzt zu haben. M85 ist ein israelisches Produkt welches unter der Bezeichnung DM 1385 als Kooperationsprodukt der Firmen I.M.I und Rheinmetall hergestellt bzw. angeboten wird. M85 wurde zuletzt im Jahr 2006 in großer Stückzahl im Libanonkrieg von der israelischen Armee eingesetzt und erzeugt eine Blindgängerquote von mindestens 10 Prozent. Über Opfer des georgischen Einsatzes ist nichts bekannt.

The Austrian Cluster Munition Coalition deplores Russia’s use of cluster munitions in Georgia and calls on the Austrian government to protest this use of cluster munitions, a banned weapon, in the strongest possible terms.
“We deplore Russia’s decision to drop cluster bombs in populated areas of Georgia this week,” said Judith Majlath.. “Russia’s use of this indiscriminate weapon is shameful both because of the civilians casualties and because it is an affront to the majority of the world’s nations that have agreed to ban cluster munitions.”

The Diana, Princess of Wales Memorial Fund is today announcing details of 36 new grants awarded to civil society organisations lobbying states to sign and ratify the Cluster Munitions Convention in Oslo in December 2008. This follows the recent success of campaigners at the Dublin Diplomatic Conference (May 2008)
The grants are aimed at making the Convention a reality as quickly as possible. By supporting organisations encouraging key states to sign and ratify the Convention, the Fund hopes this indiscriminate weapon will no longer be able to cause unacceptable harm to civilians around the world.

On 13 June 2008, CMC Austria received the prestigious Media Award 2008 for their high profile and successful advertising campaign “Were this flyer a cluster bomb, you would be dead..”. The campaign, created on the occasion of the Vienna Conference on cluster munitions in December 2007, received awards in the “Excellent Media Strategy” and as the “Most creative campaign” in the “Excellent Media Strategy - Budget Under Euro 200,000” category.
The directors of CMC Austria, Judith Majlath, and of the Wien Nord Agency, partner in this project, received the award at a well-attended ceremony, which provided an opportunity to give recognition to the cluster munition issue and the to the hard work of CMC Austria. CMC Austria was instrumental in achieving the adoption, in December 2007, of a national law banning all types of cluster munitions and requiring the destruction of stockpiles within three years.

Von 19.-30. Mai finden in Dublin formelle Verhandlungen zu einem internationalen Vertrag über ein Verbot des Einsatzes, der Lagerung, der Herstellung und der Weitergabe von Streumunitionen und über deren Vernichtung statt. Etwa 100 Staaten werden zu den Verhandlungen erwartet.
Strittige Punkte der Verhandlungen sind:
• die Definition von Streumunitionen;
• ob es eine Ausnahme für gemeinsame Militäroperationen mit Nichtvertragsstaaten geben wird;
• die Frage einer Übergangsfrist, innerhalb derer Streumunitionen erlaubt bleiben sollen;
• ob eine begrenzte Anzahl von Streumunitionen zu Trainingszwecken zurückbehalten werden dürfen;
• ob Staaten, die Streumunitionen vor Inkrafttreten des zukünftigen Vertrages eingesetzt haben, einen betroffenen Staat bei der Räumung von Blindgängern unterstützen müssen;
• die Frage, wie weitreichend eine Verpflichtung zur Opferunterstützung sein wird;
• sowie wieviele Ratifikationen benötigt werden, um den Vertrag in Kraft treten zu lassen.

On 18th February 2008 governments, campaigners and survivors of cluster bombs from around the world will meet in New Zealand to decide what a treaty banning cluster bombs will include. It is the most significant disarmament conference the New Zealand government has ever hosted. Some governments are trying to weaken a treaty by calling for exemptions based on dubious technical fixes. The CMC are calling for the strongest possible ban on cluster bombs.

GLOBAL DAY OF ACTION GEGEN STREUMUNITIONEN IN WIEN 5.11.07
Am 5. November wurde in über 40 Ländern der Welt der Global Day of Action gegen Streumunitionen abgehalten. In Wien startete CMC Austria an diesem Tag die Unterschriftensammlung für die weltweite Petition gegen Streubomben. Die ersten Unterschriften wurden dabei von Frau Außenminister Ursula Plassnik und von Frau Parlamentspräsident Prammer gesetzt. 
CMC Austria organisierte dafür unter dem Slogan „MAKE IT HAPPEN“ eine medienwirksame Inszenierung, die vor dem Außenministerium und vor dem Parlament abgehalten wurde
Über 25 lebendige Silhouetten symbolisierten die Opfer von Streumunitionen. Diese schwarz gekleideten Silhouetten trugen Botschaften, die zum Unterschreiben der Petition aufriefen.
